One legal issue with “Musk takes the checkbook” is that it seems like several Musk lackeys (or Musk himself) will be exercising substantial authority pursuant to public law. That’s unconstitutional, as they weren’t appointed consistent with the appointments clause or other applicable law

Could any President say "I don't want their DHS with a head requiring confirmation I'm going to create my OWN DHS and I'm going to say the appointee who runs it requires no confirmation!!!! But also I need all the data and files from old DHS and any employee who signs a loyalty oath can come over"
