Judge set another hearing in a couple weeks. We have had no contact with our client nor been given any document by the govt detailing under what authority he was removed. ICE told us today they won’t facilitate our communication with him or make him available for his next hearing.

Our client was falsely accused of gang affiliation, was given no chance to refute it, then was disappeared by ICE & sent to a prison in El Salvador. Before seeking asylum, he’d never even been incarcerated or arrested. Now he sits in a prison notorious for human rights abuses & his fate is unknown.

By definition, no, because habeas corpus would require that they even admit they have someone, which they've been resistant to doing.

If they don't have to prove the status of their prisoners, then there's no way to verify it for anyone. This is why the constitution *needs* to apply to immigrants.

There is nothing normal about this. Normally a removal order would not come without a hearing on the merits of the case. The Judge is setting the case out for a couple weeks because neither they nor ICE know what to do right now because the circumstances are so unprecedented.
