I am in no way even up on legalese and procedure, but I did find it odd that the original judge who granted the injunction used the words "not a nice guy" when referring to Pike.
For more on the bizarre decision that had serious implications for free expression and press freedoms, see this detailed backgrounder from @charlesrusnell.bsky.social in @thetyee.ca:
I'm reading this article and I'm... mystified? Appalled? Goggled? By a judge of a superior court saying she's unfamiliar with the fair comment defence and granting a temporary injunction over it. Right move to delay a ruling til now frankly.
Not everyone runs into everything and I get that keeping up is hard for everyone. It's just surprising, because it comes up so often at the superior courts.
Yeah, but a judge also doesn't just wake up and pick up a case. The case is given to them, they have time to look it over, and especially, If someone's going to cite a defense - The very least you could Google it 😂
When freedom of expression is involved, sarcasm isn't called for.
She also seems to take Mraiche's claims of threats against his and his family's safety at face value, so I'll assume that there was some sort of evidence involved.
Some “followers” of his podcast (probably trolls put there to cause this trouble) wrote some “threatening” things in the comment section of his post. Anyone who has tried to comment on a RWNJ BS post gets far worse. It’s a BS case, for sure an attempted SLAPP.
that's a wild comment for a judge to make regardless of the individuals employment? are there only certain classes of Canadian that are entitled to be "interested in matters of government"?
Yeah it's important for people to recognize that she could be talking about any of us, absolutely any Canadian, publishing their opinions about government.
"KIND OF ODD INNIT? THAT SOMEONE LIKE YOU SHOULD BE WATCHING SOMEONE LIKE ME?"
Who did you play for?? And when? I played Juniour A with the Magicians then Jolane Juniors 1990, 1991. We may have played against one another as we played in the women’s league.
IANAL, but I think the standard for the injunction is no possible defence. I'm not sure who has the burden, but obviously Pike has a defence. Several in fact.
I don’t think the case is over. The injunction is lifted, but there’s still a $6 million lawsuit that doesn’t come to trial until May. The breakdown can now continue to broadcast, but this isn’t over yet

wise advice from a hero of mine:
When they try to silence you, BE LOUDER!
Whether he is or not, isn't that immaterial?
Gross
Doesn't mean anything of course, but it's interesting.
citizens? interested in government? omg what's next
time to retire, Doreen
We can now call them what they truly are.
NAZI SHITBAGS!
But that said, not impossible.

Someone needs to take her down off of that horse
Is this judge a high ranking member of the UCP? 🤬
“I can say that perhaps Mr. Pike is not such a nice guy but I cannot rule on this, this afternoon,” the judge said.
Was she any good?😄
Did I miss him calling her names or something?
Seems like a really nice guy in his podcasts.
Didn’t the judge give him an ultimatum last week which was essentially “put up or shut up”?
