I think they DO know it. The 504 is what allows our kids with add to take their meds, sit closer to the front/teacher, get help with notes, longer standardized test taking time in a separate quiet area, etc. RFK has already let us know that he wants our kids off their meds.

I have a child with an IEP and one with a 504 both with autism. We need these plans to give kids a better chance of success in school and life. Sometimes small help ranging from allowing noise canceling headphones, extra time for slow readers/ test takers to having technology to aid in responses.

There was a filing yesterday clarifying the suit under the new DOJ. From what I understand, states are now arguing that 504 IS constitutional, but that its integrated setting/minimal institutionalization provisions ARE NOT.
