I think their argument on this point is correct: native americans did not have birthright citizenship via the 14th Amendment. Congress later gave them birthright citizenship by statute (as they did with people born in PR).

I mean, if Jus Solis doesn't exist, then the only way to be a citizen is to be able to trace Jus Sanguinis to a naturalized individual. Prior to 1940, no documentation was required to live here, and many (most?) arrivals were never formally naturalized.

The fact is that the 14th amendment didn't create Jus Solis. That was the rule in this country from the colonial era. (Naturalization was possible, but not required. You just settled in, worked, and your kids were citizens. The 14th amendment just made it clear it applied to non-white individuals.

Even thought it was wrongly decided and the decision is absolute racist drek, Elk is still good law from the standpoint that natives needed a law to give automatic citizenship at birth. It's just that we've had that law for 100 years now so every native alive now was a citizen at birth.
