Why have a constitution if nobody reads or follows it?
It has worked so well for years, and in a few days the donald has made a mockery of a great institution.
Even if the 14th amendment didn't grant birthright citizenship (which it clearly does), how is it even possibly functional to do this by Executive Order? Does President AOC get to issue an EO saying that birthright citizenship is restored? What about people born under Trump? Chaos!
I mean, "anchor babies" weren't a concept in the 19th century. The amendment says what it says though. If Republicans want to change it they should propose an amendment. We can't just yo-yo back and forth depending on which party is in office.
Non-citizens in the US are clearly subject to the jurisdiction of the US. The fact that the parents are subject to criminal prosecution and deportation means they clearly are, in fact!

Some countries restrict birthright or naturalization citizenship. Until this administration, the US was not one of them.
If we're being honest, my ancestry (3 immigrants in the late 19th century, 1 English indentured servant on the Mayflower, and 1 Narragansett ancestor) doesn't get me much.
It is a fairly simple concept. If you are born in a country, you were not born anywhere else, so you cannot be a citizen of any other country, because common sense dictates that you really are a citizen in the country you were born in, unless racists want to exile you from your own country of birth.
This is not accurate – many countries have either no birth-right citizenship, or a watered-down version.
However, the US constitution, as it stands right now, is very clear – *anyone* born in the US (bar children of diplomats) is automatically a US citizen.
Yes, you are correct. I just think the moral and common-sense argument has value in this situation. Legal realities are less likely to impact people who are tired of endless legal battles over rights, but moral and logical framings of ideas resonate with different groups who stopped listening.
