Thanks. This is timely and outstanding. Work like this should set the norm for academia in these times. It is time to speak out clearly and loudly, as you have done here.
Exactly right. Worth pointing out this is same approach these people take to their religion; making an idol out of the bible and christian-identity while ignoring "the weightier matters of the law", as Joshua put it, of mercy and neighborliness.
The reasoning of those who mix a particular authoritarian, wealth-worshiping sect of Christianity and politics has magnified this flaw. “This people draweth nigh unto me with their mouth, and honoureth me with their lips; but their heart is far from me.” Matt 15:8
"Scholars who suggest that arguments for the constitutionality of the order deserve a serious hearing are—whether they realize it or not—providing cover for the enemies of the Fourteenth Amendment, and indeed of republican freedom." Preach!
Yes! I think limiting ourselves to the framework of constitutional or not is limiting given the nature of the constitution’s composition AND!!! it’s crucial not to accept the biased Supreme Court’s ruling on what is and isn’t constitutional.
HISTORICAL FACT WHY!
“The Dred Scott v. Sandford ruling. Before the 14th Amendment, the Supreme Court ruled in Dred Scott v. Sandford that people of African descent were not citizens!” It was also a response to decades of pressure from African Americans to be recognized as full citizens.
It is no exaggeration to say that the leading case against birthright citizenship would not only result in a 14A that fails to overturn Dred Scott—it resembles Dred Scott’s theory of citizenship.
If I’m reading this correctly, it looks like there might be a movement to limit citizenship to certain classes like Ancient Rome. Maybe a future move to limit voting to white male landowners or something.
It's incredibly funny and sad how they're trying to emulate these alleged great civilizations of the past by doing the exact shit that caused them to collapse.
Yes. I have long said that the Supreme Court implicitly held in Shelby County that the 14th Amendment is past some unspoken expiration date. Ending birthright citizenship is of a piece with that
It is white-male-superiority that is threatened by general equality. None of us choose to be born, we find ourselves where we are.
Will this administration force those born in America to justify their citizenship at a certain age? By what standards? Where are rejects sent? At what age?

"Gotcha."
"Here it comes, the bad-faith argument."
"Yep, bring it on."
"Understand, this is to advance our agenda at the expense of norms and decency."
"Yes."
"Bad faith starting now."
"Righto."
"[BAD FAITH GARBAGE]"
"Good points, let's talk about it."
