Yes but Merchan did what he had to do to get past SCOTUS and be able to sentence him. If he wasn’t sentenced before he is sworn in he could have his DOJ drop the charges and vacate the verdict. Right now he’s been found guilty of 34 felonies. Tomorrow he will be a convicted felon legally.
