Key point: the USMS was established in 1789 — predating Justice by 80years.

Glenn’s point: the 1st Congress established the USMS and charged that they SHALL execute the orders of the Federal Judiciary.

Will be up to SCOTUS to decide if it is an Exec. agency or agency of the Fed. Judiciary.

Functionally, the executive would still have the judiciary by the balls. The executive controls the Bureau of Fiscal Services, which disburses funds to the judiciary (and everything else). They could just cut off all funding to the courts and USMS.
