Very unclear what is happening, but my guess is DOS moved to revoke his F1 visa and referred him to ICE not knowing he had adjusted status, and something got lost in translation because they didn’t realize their own incompetence.

It’s still a bit mysterious because how can they (just at a practical level) revoke a visa that doesn’t exist? Seems like the revocation has to mention a visa number.

What I’m saying is his visa probably did exist and may have even been facially valid but it was effectively no longer in use because he adjusted to LPR. Presumably this would be reflected in SEVIS but there are often data errors in SEVIS.

Reading 237(a)(1)(B) again, I’m wondering if in the future they could read it aggressively to deport an LPR by revoking a past nonimmigrant visa, even if it’s no longer being relied on.

Lennon’s case started over whether to approve his application for a green card; it hadn’t been granted yet.

Additionally, the (ostensible) grounds the government used to argue for denial was a prior drug conviction in the UK; which is to say, they made an actual argument about it 🤷🏻

I personally am very cautious using language like this. We know which detention center he is in, and the reason I’m pointing to what happens next is that, when people with legal status are detained by ICE, they are often released once the error is discovered and nothing further happens to them.

Detention is a terrifying prospect. I don’t want people to be even more terrified because they think it means being disappeared. That’s the sort of thing that leads people to not just not speak out, but not leave their homes.

I hear what you are saying, but I was recently incarcerated myself at a Federal prison where women were cut off from medication, had a sexual predator in charge of their health, denied access to lawyers, even to boots and salt. Any second under the “care” of this government is a crisis.
