For…the guy killed a man in front of dozens of witnesses. Of course it goes to trial. He was found not guilty. He should take the W and hope there is no civil trial.
A lot of the comments here are being posted by people who have clearly never ridden the NYC subway at night and been confronted by a clearly dangerous mentally ill person
My understanding is that they said they were deadlocked on both counts, and the prosecution asked for and received dismissal of the top count, apparently hoping that they'd split the difference and convict on CNH. Defense was likely surprised too, they had asked for a mistrial this AM.
Yep, and apparently one juror wanted conviction. Likely the convo was: 11 jurors "if you want him convicted, how much time would you want him to serve." Holdout juror: "None or minimal time." Rest of jury "then say why are we convicting then? He aimed to protect people."
I think the jury decided to just make the whole thing go away. They thought Penny was just being a good samaritan and something went wrong and rather than punish him criminally for trying to do the right thing they let him go.
I have sympathy for those who have to live in fear of people like Neeley. It's time to think of them and not of the deranged who threatened them. This is very good news.
this was always going to be a case not about whether he murdered someone, but about what kinds of murder are acceptable to us. this is a shameful verdict, piss in the face of anyone who beliefs in universal human dignity. i wish i was more surprised.
There is a lot of misinformation circulating about choke-holds and choking. As someone who practiced practiced and taught Jujitsu for 20 years... Sometimes it is not immediately apparent that someone has passed out. Do not choke someone out unless you have significant training time.
Whatever no profile pic (troll/bot red flag). It’s one thing to defend/protect someone by subduing a threat, even if causing serious injury, but another thing to choke life out of someone.
And you were there? You sat in court everyday and listened to all of the testimony? Who started the confrontation? Penny or the psychopath with a violent history?
This acquittal is such BS. The jury believed that he died of a combination of Sickle Cell, mental illness, and drug use. They ignored the coroner's report. This was similar to the nonsense they tried with George Floyd.

Dude choked a man to death right in front of dozens of witnesses. Whether he intended it or not, that’s supposed to be some heavy fucking shit. Reckless Homicide was what they convicted the young woman who ran over my Dad in ‘99. Seems like a couple years in the pokey would cover it.
all beside the point-- he was executed for disorderly conduct (had no weapon, had not assaulted anyone). Now it's going to be open season for white supremacists to attack, injure, and kill black people for being "uppity"
To subdue him, sure, to kill him by strangulation, hell no! If restraint means you can cut off someone's air supply until they're dead, I'm no way in support of that. America, the judicial system and it's citizenry have a history of murder when they see fit.
No institution wants a fatality on their grounds, or within their jurisdiction. Him having vital signs after being choked for 6 mins and dying at the hospital is so ppl can avoid investigations. Police refusing to perform cpr is a testimony to his diminished mental capacity in my estimation.

This jury did not find the case was proved beyond a reasonable doubt. It is a tragedy that those with mental illness don’t get the help they need before they become a danger to themselves and others.
I will consider him a piece of shit forever. As all MAGAts are.

Mental illness is not a crime. That bus had another exit ever passenger could have safely used. Mr Perry's sociopathic racism led him to attack Mr. Neeley. Anyone can have a psychotic break with reality. I once had one myself and was lucky to be surrounded by loving family until it passed.

Jurors take the train too. As a NY subway rider I'm not at all surprised by this. Frankly, it's terrifying at times. Not endorsing, just an observation.

He wasn't pronounced until he got to the hospital
Police at the scene refused to do CPR on him because they thought he'd put them at risk of Hep C infection
There is a time gap between Penny releasing him and Neely dying that Penny isn't responsible for
