“Sometimes overlay zoning matches surrounding neighborhoods” does not refute that Nashville’s overlays are used as a way to keep neighborhoods under-zoned compared to their neighbors (and compared to market demand), artificially constraining supply and making housing in Nashville more expensive.

The MHZC only reviews some permits on properties that are located in Overlay districts whose creation and boundaries were set by Council. They do not review permits in the city as a whole. In many cases base zoning inside Overlays is similar to zoning in surrounding neighborhood outside the Overlay.
