It is truly amazing to me how many people think the equal protection clause should just *not apply* when they think their bigotry and discrimination is *justified.*

It’s sad but I’m not really surprised how many people believe that. It’s the same people who think separation of church and state doesn’t apply to Christianity.
Like there are a TON of people I actually fucking hate. And they exist in cognizable groups. And I would very much like to make laws that prevent them from, I dunno, breathing on me. Or voting.
BUT I CAN'T MAKE THOSE LAWS... because of the equal protection clause.
Idea: Maybe we should just pretend we're all maga (deck out our profiles with flags, bad grammar, etc) and spread all of our left wing ideas that would actually help people. Feel like we'd have most of the maga base screaming for single payer and amnesty for immigrants within a few months. 🤷🏻♂️
I don’t think they will. Elie is on the wrong side of the political spectrum and the wrong skin tone. He’d have to go full blow Clarence Thomas just to get his foot in the door.
I know you will explode in a second, but when there will be an open, discussion about trans-women competing in female sports? With medical experts and sport medicine/performance experts? without shouting and emotions, just facts. And no lawyers.
I know rationally what is happening is backwards engineering to justify the desired outcome, but I still just can't comprehend that we have a SCOTUS which just ignores the 14th Amendment. Please tell my I'm missing something here.
It's an uncomfortable thing to talk about, but the reality is:
The *only* mechanism the Constitution gave us for when SCOTUS starts ignoring or even outright nullifying the Constitution is to *DISREGARD THEIR RULINGS*
Sadly that works both ways and the right would more than welcome being able to ignore the court rulings that go against them. Its really just a shitty position we find ourselves in.
I think it's the regularity of it now being ignored. Dobbes, CO, now Skrmetti, the lack of recognition of precedent, the lack of a consistent judicial philosophy, the confusing of policy with constitutional issues. So maybe bad enough in the past, even worse in the present?
Yup. Amazing how many people actually believe that there can be any justification for bigotry and discrimination. I miss the good old days when people felt constrained to hide all of that ugliness. Maybe it’s better to know but it sure is creepy.
The same people who scream we're a "constitutional republic" rather than a democracy. Clay Higgins out of Louisiana says this over and over so that his vileness is somehow excused. John Roberts is essentially in this camp but with a smoother manner that hides his hideous views-especially on the 14th
