After the paperwork was done they gave me my stuff back, a copy of the citation, and let me go. Overall time spent in the jail was about four hours, and I give it 4.5 stars out of 5 (the metal bench in my cell could’ve used some cushions)

Usually they will intentionally leave it on so that when you get released at 3 am (like you said), you can't call anyone for a ride or let your people know you're safe. They like doing that because it's fun.
It is always a good idea to power off (or at least reboot without unlocking) your phone if you're likely to get arrested - the encryption is more comprehensive before the first pin unlock
Yeah - physical custody has all the weaknesses. I wish they had a key-combo to put the phone in BFU state (like you can with requiring pass code to unlock)
What about on the iPhone when you can get to the power off screen, go away from the screen without powering off, and it requires your pin after? Is that the same protection as first pin unlock after a power off?

It IS less protected than a fresh boot, so you might as well power it off to be safe when you get to that screen.
What is the monetary effect of this? Fines? Legal Fees?
