A. We, the people. The heart, the purpose, the living embodiment of the US Constitution & the spirit of democracy OR
B. Musk. The h8, fear, division, the living embodiment of everything that's unconstitutional & the spirit of fascist authoritarism.
I keep wondering where Vance is and what he’s up to. Makes me nervous why we haven’t heard from him since the election. What sort of chaos & debauchery is HE up to?
Neither courts nor legislatures possess or are granted the means to enforce laws - that's a function of the Executive. When the Executive is determined to ignore the laws, the people have little to no recourse within the framework of the Constitution
I appreciate your work, Marc, and I agree about continuing the battle against fascism. And perhaps you'll make some headway with the NYT, who's been overtly kind to trump, the magats, and musk and dismissive to the Dems to date. Maybe it will return the the kind of journalism it used to practice.
@raskin.house.gov Please start a class action suit against Trump as you described on The Weekend! Millions of us are waiting for a leader and event that will bring us together in force. This would generate huge energy and could be a beginning of the end - our SOLIDARITY! Please be our Lech Walesa!
Saw a repost from another corporate reporter who stated recently “we are on our own” and thought about you ringing that bell for some time. When they can’t get it right on their own, they “borrow” from what they were originally ignored.
Assuming they care to follow the rule of law. And who, exactly, will be there to enforce the courts rulings? Democracy is a social construct and contract but we now have fascists in charge who want to change this contract.
The courts are also rigged to lean right. We can’t fight a crumbling democracy with democratic means. The people associated with this admin will just lie under oath and everyone becomes Susan Collins. Very difficult to watch.
Marc,
I'm willing to sign a class action lawsuit against Elon Musk and the Federal Government for misuse of private information. The Computer Fraud & Abuse Act of 1986)
Hoping your guys are on this...
I think that's true in a sense. However, infiltration and corruption of the U.S. Treasury in particular could mean very bad things for the economy. Courts may be able to get Federal Marshals on the scene to enforce the old constitutional order. People help, but can't do that directly.
I hate that I can't convey tone in text so please don't think I'm being flippant, but I sincerely hope you're right. I can't stress enough how wrong I want to be.
NYT may finally be waking to what was obvious for 20+ years: the Trump lies. He tells big lies and he tells small lies, but he always lies. But the NYT wouldn't say he lied, instead using soft euphemisms or some say, or on the one hand phrasing to soften the blow.
No they aren't because SCOTUS has been compromised for a while now. This along with recent reports on a WH planned Anti-Christian bias taskforce and attacks on non-evangelical religious groups like Catholic and Lutheran is alarming.
Can you PLEASE ask Dem leadership to support the special elections? There are 3 seats...2 in FL & 1 in NY. They could get the house back or tie in 60 days. Apparently the Dem party is doing NOTHING to help them. No one is speaking about it besides AOC. The Dems need DO SOMETHING to help NOW!!!
One in FL is my district. We're calling, mailing cards, and our candidate, @joshweil.bsky.social, is working so hard to be out in the community getting to know people. He's running against Randy Fine, who is so sure he's going to win, he uses MAGA soundbites instead of real solutions.
We should use courts to their full potential but they hate our government and courts, they will do everything to disregard them. We have to start strategizing if those guard rails are ignored.
All mainstream media are so late in their coverage of this circus. They can’t do honest, timely research anymore. Journalism is dead over there. It’s pathetic.
Right now, #resistance is vital to our survival. #resistance is vital to our freedoms. We must use our wallets and fight back. Money talks. We cannot afford to give an inch. They WILL take a mile.
And meanwhile people will be celebrating the Super Bowl with the NFL bending over for Felon47 and the dismantling of our government minute by minute. Enjoy your beer.
Maybe if we goad them a lot (I hear tell that electric cattle prods would work), they may catch up and actually be worthwhile again!
For right now, I trust the NY Times about as far as I can throw its building; and only respect a very few of its reporters and editors! Even I have standards to keep!
What happens if Trump defies court orders? When the courts try to send out US Marshalls, what happens if the AG, (Pam Bondi) who is in charge of the USMS, refuses to comply, refuses to send out the Marshalls? What's the next plan?
If courts were a guardrail then 1) Trump wouldn't have been on any state's ballot, 2) Trump would be in Rikers, and 3) Trump couldn't legally order Seal Team 6 to assassinate a political rival.
Face facts: every US institution (that wasn't already bad by design) has been compromised.

Please understand, @marcelias.bsky.social and @briantylercohen.bsky.social, that you are falling into the same trap that Bob Mueller did.
Mueller had an almost religious veneration of the DOJ's rules, even the Nixon-era OLC memo, and a naive belief in Congress's ability to do the right thing.

The courts will not magically fix things. Courts didn't get rid of George III. Courts didn't end slavery. Courts didn't give women the right to vote. Courts didn't end segregation. Courts didn't (temporarily) end Trump's rule.
And who is exactly going to enforce these rulings? Is the GOP-controlled Congress going to impeach Trump and his minions if they don't comply? Are the Trump-controlled FBI or the DOJ going to arrest him?
Resist the Stupidity, Racism, Fascism, and criminality of FOTUS and his associates. Expose their actions which violate ethics, laws, or democratic principles. IMPEACH TRUMP!
Elon Musk spent $277 million to elect Donald Trump President.
In the three months after the election, he became $154 billion richer. He is on his way to becoming the world's first trillionaire. This is what oligarchy looks like.

It'll work even if Trump orders US troops to shoot us (which he already tried to do during his 1st term).

I despise the complicit New York Times.
Why does anyone still read that rag?
And why does this sound so familiar? Aha!

As proven by President Jackson, the courts have no power to enforce their rulings on a rogue executive

Our rules are not sacred.
Our institutions are not magical.
Our system does not ensure that people will do the right thing.
And, most of all, our Executive controls violence. It has the guns. Congress and the judiciary don't. That's why it's presidents who become dictators.
The courts will not magically fix things. Courts didn't get rid of George III. Courts didn't end slavery. Courts didn't give women the right to vote. Courts didn't end segregation. Courts didn't (temporarily) end Trump's rule.
You know what did? PISSED OFF PEOPLE.
And in 3 out of the 5 examples I listed, the pissed off people ended stretches of horror NONVIOLENTLY.
How?
THEY GOT INTO THE STREETS AND MARCHED.
Just being punchy here.
