4/ And a little side snark— the next time MAGA wants to, say, ban access to medication abortion on a nationwide basis, this will apply to them too. I’m off to study for decision, but you’ve got the broad contours.

That would be....yes.
Born in California? you're a citizen. Texas? Not a citizen.
Think about the financial cost of taking these federally applicable EOs to every single district to stop them. This is a horrific ruling and we see SCOTUS' belly as they roll over to Trump.
looking at 2026 and 2028 i would go a step further: Imagine you were born in TX and wanted to vote in CA.. This will be one of the most consequential bullshit rulings of the decade..
This was what I posted on the other platform in response to a Fox TV personality who was gloating about the ruling and Barrett’s writing for the majority.
Once again, justice delayed is justice denied. Thanks, Joe, for not moving to expand the Supreme Court. SCOTUS is now a rubber stamp for fascism and I've given up on our democracy. We're too stupid to see that and stop it. We deserve this destruction of America.
absolutely, the VRA was gutted because SCOTUS ruled the federal government can't legislate elections in Alabama, that will surely bite conservatives in the ass when Colorado correctly interprets the 14th Amendment to remove Trump from the ballot in 2024
Sorry but we have an extremist court now, Biden coulda saved our Republic in 2021 but chose not to pack the court along with DINOS who refused to nuke the filibuster.
They will allow nationwide injunctions against abortion rights etc.
SC once again revealed its intent to decimate the Constitution and install tRump as Emperor of a Christian nation. We can not wait until all of the Democracy-supporting lower court decisions are laid to waste. We must start to discuss NOW how to respond when the SC erases all vestiges of Democracy.
I like the “side snark” language. There must be a t-shirt-baseball cap made.
Your other comment about “this will apply” seems very hopeful and therefore a lot less amusing.
Can lower judge just ignore a Supreme Court ruling? I such a judgment would be swiftly appealed. Feels like it’s time to ignore this court completely but that’s easier said than done.
I read this is how the Scientologists managed to get themselves classified as a religion for tax purposes - thousands of them sued, until the IRS gave in.
@joycewhitevance.bsky.social appreciate your optimism that this will apply equally to right wing causes like medication abortions. It won’t. If our Republic is to survive, we must face the reality that these people not care about the constitutional order.
SCOTUS is speedrunning us into a fascist dictatorship with 6-3 decisions by the court. There's no silver lining left. The legal system has zero credibility. The rule of law is dead. The only thing that saves us now is ourselves, and a complete overhaul of the US government.
So should classes be carefully constructed to include persons from each district, or each state, such that the class itself could only receive TRO or PI relief from a nationwide effect?
How can this procedural hoop be addressed by strategically crafting the class to render this decision moot?
And you're glossing over the whole point in your haste to waive this away: a federal judge placing an injunction has been enough to stop executive overreach for basically the entire history of our country until this president and this court. It IS a huge deal.
I like Joyce a lot - and while I've personally never noticed this from her before - a lot of former DoJ folks seem to have a "It's not so bad" default setting.
This decision could be a lot WORSE than it seems not better.
Agree. I understand the Constitutional professors are just laying out the reality of our situation: if corrupt Justices, lawyers, and politicians want to destroy democracy, they can. It just takes an ocean of money and they have it...stolen right out of our taxes with backroom deals.

not a citizen = nationwide.
So once you're a citizen, that must be recognized nationally for the rest of your life.
not a citizen, that must also be recognized nationally.
wait

I respect Joyce but I'm dumbfounded she's trying to find any silver lining in this abominable decision.
This decision could be a lot WORSE than it seems not better.
There is no silver lining.
If Trump, the GOP, and the Supreme Court are this far down the treasonous road, they're not going to stop now.
