The EO def x-refs 5 USC 2105, for whatever that's worth. But if it doesn't include PAS comm'rs, it creates an even more untenable result: that the Senate-confirmed comm'rs of an agency could by majority vote take a position of law contrary to the WH and then agency staff would be bound to disobey.

For decades, the AG has delegated to DOJ's Office of Legal Counsel the job of providing controlling advice to Exec Branch on Qs of law. Since 1960s, OLC has also signed off on the legality of all EOs. OLC is mostly career staff. My guess: OLC balked at this EO especially & is now off law island. /4

A potential better idea would have simply been to allow state courts to overrule federal laws within their state. Assuming they were passed below say, a 70% vote threshold, any state can strike down that federal ruling.
