Tama Potaka would not have made the decision. He said it wasn't his decision to appoint Prebble, as it was a coalition agreement. He didn't sound happy with the process

Waitangi Tribunal members are appointed by the Governor-General on the recommendation of the Minister for Māori Development.

Potaka may have appointed him, but Prebble is a former ACT leader and pressure would have been applied, via cabinet, for Prebble to get the position. He would not have been picked by Potaka.

At best the tribunal was about appeasement at the lowest cost to the govt and non-apologetic and land-owning Pakeha. Yet it worked in some ways, to bring about a rising tide for some iwi and hapu.

Tampering with the Tribunal is a message that this same old guard feel they have "done enough".
