As @rparloff.bsky.social points out, Alito misrepresents the facts here.
During the hearing, Ensign (for DOJ) said he was *not aware of* any plans for removal on Saturday. But he added that the government would be within its rights under SCOTUS’s J.G.G. decision to conduct removals that day…

A President, SCOTUS and Congressmen all have rights above that of citizens derived from an election.
Do elections create kings?

ACLU suggested that the gov be required to file a declaration stating no plans to remove, but gov didn’t volunteer to do so and Boasberg didn’t require it…
The motorcade ultimately turned around and returned to Bluebonnet.

The other issue is the blatant failure to provide the notice that SCOTUS required.
But clearly, the govt’s other attempts to evade the courts couldn’t have helped.
Is that how lawyers see it too?
And any idea why Boasberg didn't require DOJ to make that declaration that there weren't on Saturday?
It doesn’t appear that the government gave these people 24 hours to contact their lawyers. Is this not a violation of the court order?
I mean… it’s good that the Supreme Court stopped that. But is the government’s lawyer going to be held accountable for lying to the judge?
That said, for the purpose of protecting the rights of those about to be sent to a concentration camp artfully placed in another country to avoid the appearance that the US has jurisdiction it is - at this moment - a distraction.
DOJ lawyers lying to judges is part of the whole pattern of lawlessness.
It matters.
It *all* matters.
It was a carefully worded statement intended to mislead the court.
I’m guessing Judge Boasberg — and most other judges — would treat that as a lie.
- Drew Ensign or something.
In plainer English, Alito lied. Just like the DOJ lawyer Ensign also lied when he said no deportations were planned for Friday night when 27 men had already been loaded on a bus and told they were going to El Salvador by guards at the ICE detention center.
Impeach Alito and Thomas!
Unreal.
Alito is a fucking liar and a hack. I can barely make it through reading his writing since it's so fucking awful too.
ACLU's point is that the Executive may not be, and an opportunity for review is needed.
As I recall from the call, Ensign clearly stated that the government would "reserve its rights" to transport people on Saturday.
It was that statement that gave me the most pause.
That’s lawyer speak for, “This is bullshit, but I’m just the mouthpiece.”
Alternative facts...
What the actual fuck? We're all adults here.
Why can't you just say "lied?"
Why is that so hard? He lied.
