14th Section 3 wasn't nearly as simple - who determines "this guy did an insurrection" isn't a trivial problem to solve (they solved it badly, but still). And basically no one seriously grappled with 14th Section 3 between 1877 and 2021.

22nd's plain as day.

they'd probably argue Trump v. Anderson means the 22nd amendment, like the 14th amendment, can't be enforced by states to restrict ballot access without enabling legislation. that (very bad) precedent does support that proposition.

I think they'd lose that argument, but I have low confidence.

i do not think a certain kind of person realizes that "hitting bottom" is really more of a metaphorical concept and that there's always a long way you can go before you get there
