A man driving into a crowd, killing 9, during a cultural festival isn't terrorism because we expect that sometimes, drivers make oopsieses and murder people with their cars.

What I heard is the the driver kept edging forward, directly into the path of the main mass, so he sat on their hood.
So no consequences for abusive drivers are even conceivable.
