Laws are agreements. The value of things (dollars, gold, stocks, Bitcoin) are agreements. Societal norms are agreements. When enough people disagree, things change.

MERKLEY: Are you gonna launch an investigation of the reported violation of the due process of several hundred people? P: It is not for me to call the balls & strikes M: You haven't read the Constitution? It says 'all persons'...it concerns me you're not familiar w/the core concept of due process

Your School House Rock moment......

💯

This is your regular reminder that executive orders are not royal decrees. Because America has no king.

If you want to engage and do more than post your horror on social media, this is one option. open.substack.com/pub/jonathan...

Time for another digital security PSA with guitar … here’s “All the Small Things” but it’s about scrubbing metadata from your photos before you post them 🤘

Exactly this. It's just like when they tried to justify George Floyd's murder by calling him a criminal. IT DOESN'T MATTER. Criminals are entitled to due process - that's how we determine if they are criminals.

Friendly reminder. In the United States, criminals are entitled to due process. Even if you pay hush money rig an election, steal top secret documents, or incite a mob to overthrow the government; no matter how egregious your crimes, you’re entitled to due process.

Personally, I think it should be front page news for at least a month if a sitting US President is using falsified evidence to try and deny due process to a man who has committed no crime, but that’s just me

"We can have democracy in this country, or we can have great wealth concentrated in the hands of a few, but we can't have both." —Louis Brandeis

Staple this to RFK Jr’s forehead.

Let’s be clear. When the President defies the Supreme Court, it is the role of Congress to remove him from office. Full stop.

I want to tell you why the case of Kilmar Abrego Garcia should matter to you. The one power you cannot give the executive is the ability to imprison or expel anyone regardless of their legal rights. That is our key check against autocracy. And we are watching it disappear.

Seems like now's as good a time as ever to re-up this.

Fascism is when a leader uses the power of the state to control or coerce private institutions—like Trump has tried to do with universities and private companies such as Apple. His attempts to dictate what schools can teach or how businesses should operate are textbook authoritarianism. Harvard

I’ve just posted this video message to members of the DC Bar, urging them to vote *AGAINST* AG Pam Bondi’s brother to be its next president. Please pass this on to anyone who is eligible to vote. www.instagram.com/reel/DIcQFxt...

Ahhhhh-YUP.

We traded Europe for a guy that builds concentration camps for profit.

I hear people all around me saying, “They are going to crash the economy. Surely they don’t mean to crash the economy.” I beg to differ. This is curated failure. open.substack.com/pub/jesspipe...

Historian here: “To announce that there must be no criticism of the President, or that we are to stand by the President, right or wrong, is not only unpatriotic and servile, but is morally treasonable to the American public.” ― Theodore Roosevelt

Called my congressman who voted for the SAVE act. Me: What documents will I need to vote if this passes? Staffer: a DL and birth certificate. Me: The documents don’t match Staffer: Then a marriage certificate. Me: Will my husband need the marriage certificate too? Staffer: No Me: See the problem?

The four law firms that it was announced are now Trump collaborators -- Kirkland & Ellis, Latham & Watkins, Simpson Thacher, and A&O Shearman Sterling -- ALSO agreed today to "Disavow DEI" as part of a settlement with EEOC. Why would any new associate join such a place? Why would any partner stay?

America. Home. Of. The. Corrupt. ✨

BREAKING: The country of Norway just entered a bill to give transgender Americans asylum in the country of Norway… LGBTQ+ STRONG! 🌈✨

BREAKING: SCOTUS says Trump admin must "facilitate" Kilmar Abrego Garcia's return. The Trump admin fought the order — over a man it sent to a prison in El Salvador in an "administrative error" — to the Supreme Court, losing at all three levels of federal courts. Tonight, at Law Dork —>

We wouldn’t be here if SCOTUS had allowed the January 6th trial to go forward as scheduled.

There are 33m companies in the USA. Only 21k employe 500 or more. And they only make up 23% of workers. Trump and Elon are ignoring the more than 32m entrepreneurs that can't afford to build a new factory or pay tariffs or absorb cancelled contracts.

What if you’re so outrageously incompetent you get it done in a matter of minutes?

Big Law firms and partners have choices about whether to capitulate or to stand tall. History is watching.

Because the first question shifts the blame to the desperate, making their morality the focus, while the second question demands accountability from the powerful. It's easier to question survival than to challenge greed.

The richest man in the world spent more money than most of us will see in our lifetimes to lose a state Supreme Court race by 10 points. And the fact his $25 million was a drop in the bucket compared to what he's spent on other elections is exactly why we must overturn Citizens United.

The Trump administration called it an “administrative error.” But that error led to a nightmare for Maryland Resident Abrego Garcia.

WOW! My friend @booker.senate.gov just spoke on the Senate floor for over 24 HOURS, blocking Trump’s dangerous & disastrous agenda, and BREAKING THE RECORD of a man who stood in the way of civil rights! This is what Democrats must do in this moment: stand up, disrupt, make good trouble!

20 years for vandalizing a Tesla dealership, a pardon for vandalizing the US Capitol.

"...institutions are held together through coordination. Because any one actor expects that everyone who matters will stand united to punish anyone who deviates..." This article is long, but has some very important points about how a coordinated response, led by a united media bloc, can win.

who wants to put on a cape and do this?

Tell me about the wins, no matter how small. What have you done (or seen done) that has moved the needle for good since the Trump regime reclaimed the levers of power?

Exactly this. Everything is made up. Agreement is power.

"Trump’s picks for judges parallel his picks for other positions in their loyalty to him...Every effort must be made to prevent more such judges from ever sitting on the bench, lest they erode the last bulwark we have against Trump’s power grabs."

NEW: A federal judge in Massachusetts has granted a temporary restraining order barring the Trump administration from deporting any person to a country they are not a national of (so-called 'third country removals') without written notice and an opportunity to apply for protection from that country.

A reminder from our friend Alexander Hamilton (Federalist 84): “[T]he subjecting of men to punishment for things which, when they were done, were breaches of no law . . . [has] been, in all ages, the favorite and most formidable instruments of tyranny.”

Of course they are.
