I spoke w/ @insideclimatenews.org about the lawlessness of the Solar for All freeze. "The president is not entitled to cut off agencies’ contractual obligations. The federal funds are NOT unfrozen, despite the D.C. court's administrative stay.

not clear to me if this really moots the case or not, but a court can keep a case live if a party engages in behavior "capable of repetition yet evading review." Basically you can't do a bunch of cute shit to moot a case and can keep putting the policy back in place

Couple of things to note about Judge AliKhan’s stay order: - It is an administrative stay - a relatively short reprieve for the court to more fully consider the issues. - It applies only to “open awards,” i.e, signed grant agreements. New grant making or other spending is not affected.

Reviewing OMB's submission in National Council of Nonprofits, and man if the chaos and confusion aren't the point. The argument basically goes that they published something on letterhead saying it isn't an impoundment so it isn't.

There is simply no plausible argument that the president has the constitutional authority to refuse to spend appropriated funds because he doesn’t like how the money is being spent. The legality of policy impoundments is just not a close question.

Turns out packing-for-a-trip anxiety and end-of-federal-funding-as-we-know-it anxiety are remarkably similar. Or maybe that’s knowing that travel time will be spent updating slides on the current state of IRA implementation and who knows what will have happened by wheels down?

NEW — OMB temporarily pauses all agency grants and loans programs. Per copy of memo: "The use of Federal resources to advance Marxist equity, transgenderism, and green new deal social engineering policies is a waste of taxpayer dollars that does not improve the day-to-day lives of those we serve."
