So he has the nerve to tell Denmark to give us Greenland. And to tell Panama to give us back the Panama Canal which is now theirs. And to tell Canada to give us their whole country. But he’s claiming he can’t tell El Salvador to give us back one man who we wrongly handed over to?

They can call it what they want, they are disobeying a court order.

Spoiler: Without the support of the US military, the Constitution is worthless.

As I’ve said, yes, this was their aim all along. That’s why they didn’t just send these people to Gitmo. This is an attempt to find a step beyond Gitmo where the court says, “Well, our hands are tied.” It’s an awful, lawless gambit that must fail, but that is what they want it to be.

If the government can pay a foreign state to imprison you and, in so doing, remove you from the protection of US law, the Constitution is worthless.

The principle at stake here is so fundamental it predates even Magna Carta in English law, and before that stretching all the way back to Rome, and has its similarly ancient equivalents in every legal system in the world, because it's the inherent bedrock foundation of what courts and laws are for.

Bukele has some constraints of his own working against the charade. His official line is they *are* being held for the US, they're accused of nothing under Salvadoran law even through the usual sham process, and b/c of that he dodges directly saying he'd refuse if the US said release or return them.

Roberts et al may try to slow this shit down but Trump is making it very clear that he will accept nothing less than the total destruction of the American judiciary and it's up to them to decide whether they submit to it or to allow the judiciary to fight back.

This is bullshit—of course the US could apply diplomatic pressure to have him returned—but if it is allowed to stand, the executive branch has the power to disappear people permanently without any sort of due process. That in turn will be the end of all other constitutionally guaranteed rights.

He is illegitimate. We have no President. Our government is occupied by criminals and traitors.

It is very good question and one I’ve been asking for months. If there is an international agreement with El Salvador for these renditions, the Trump administration is legally required under the Case-Zablocki Act to share it with Congress. To my knowledge, they have not done so.

No matter what he said yesterday, I take this to mean Trump isn’t going to obey court orders to bring anybody back from El Salvador.

There is no excuse for many members of Congress not to be calling for impeachment over the foreign gulag arrangement. This is illegal and morally depraved.

Looks like the Trump position is that if they send you to the El Salvador jail it’s a one way trip. Remember they are weighing this for citizens.

This is a concession by the U.S. government that its “arrangement” with El Salvador is irrevocable. To me this has to be grounds to argue that the arrangement itself is unconstitutional under the Fifth and Eighth Amendments

This story hasn’t gotten nearly enough attention. It is openly fraudulent what they’re doing.
