If they don't they won't go to trial. The trial is what determines the guilt or innocence of the defendant, not the prosecutor's determination.

His conditions snowballed until he did pass away. The last test they ran showed a definite problem that could be treated with a feeding tube. When that was rejected he was put on palliative care and died within eight hours. Death panel? Sure seemed like it to me. I don't know where it originated.

My father entered the hospital for the last time with a totally treatable condition. He did have several other things wrong with him. Every time I was there after that first day someone came in trying to get him (and us) to allow them to start palliative care.
