This is how you know Passover's coming when you live in the south.

How I'm feeling these days.

I'm old enough to remember when Executive Order 9066 (issued 83 years ago today) was the worst one.

I went to sleep sick over this move to bring independent agencies to presidential heel, and wake up to see ... basically nothing about it on social media. This seems like a big effin' deal. Am I missing something? #lawsky #academicsky

It should be obvious by now that a president (and party) arrogating this much power to the office of the presidency intends never to surrender it. #lawsky

Couldn't disagree more. We need to care about the motives for participating in repression if we wish to have any chance of working against it.

1/3: Feb 17 reminds us of how “danger from within” is often a dog-whistle used to justify the indefensible. #otd 1942, A. Gullion, Provost Marshal General of US Army, drafted wording for FDR’s Executive Order 9066, enabling mass removal and incarceration of 100k *US citizens* of Japanese ethnicity.

Congratulations to Eric Muller @elmunc.bsky.social on his new book: Lawyer, Jailer, Ally, Foe: Complicity and Conscience in America's World War II Concentration Camps, on the US government lawyers who worked at internment camps. uncpress.org/book/9781469...

It's separation of powers week in my Constitutional Law class!! Woot woot!! I'm ditching Youngstown Sheet & Tube v Sawyer today and teaching through this image. #lawsky #academicsky #law #constitution

A love story from history & for our time: a passion defying illegal unions, a bond born of deeply shared political convictions, & a family facing separation, torn loyalties, terrible choices, & fascist threats--in an American concentration camp. @chireviewpress.bsky.social Preorder: a.co/d/b56VZF5.

BREAKING: In response to doctors' lawsuit, Judge John Bates, a George W. Bush appointee, orders CDC, NIH, and FDA to put back up websites and datasets cited by the doctors in their lawsuit as having been relied upon and pulled down without notice. storage.courtlistener.com/recap/gov.us...

This bill was actually introduced in the US House of Representatives yesterday. They are 7th graders.

The time has come for all people of conscience to ask: Why is someone else not doing something about all this?

A bill has been introduced in NC legislature to bar the NC Atty Genl from seeking to invalidate any law passed by the Genl Assembly & any executive order signed by Trump. I'd think such an abject violation of the separation of powers would never pass - but what the f*ck do I know anymore. #lawsky

JD Vance - If you believe any of the multiple federal courts that have ruled against you so far are exceeding their statutory or Constitutional authority, your recourse is to appeal. You don’t get to rage-quit the Republic just because you are losing. That’s tyranny.

“Judges aren’t allowed to control the executive’s legitimate power” is true—but judges *do* get to decide whether the power is legitimate. If courts determine the power is illegitimate, they can enjoin it. But Trumpists are rejecting this check & proclaiming legitimacy for whatever they do. #fascism

Hey #academicsky, is there a database yet that approximates how much funding individual universities stand to lose due to the reduction in indirect costs?

Establishment … just in case there’s some ambiguity about what this is?

We are watching the performance of late capitalist brutality on federal workers: Return to the office! There is no office to return to! Resign before you're fired! You can't resign, you're fired! Take this paltry sum, which we may not give you! Stay and do the jobs of the others we fired! +

In the infamous Korematsu case, DOJ concealed key information from SCOTUS. This unethical move led to the overturning of Korematsu's conviction decades later. 𝗞𝗲𝘆 𝗗𝗢𝗝 𝗹𝗮𝘄𝘆𝗲𝗿𝘀 𝘁𝗵𝗿𝗲𝗮𝘁𝗲𝗻𝗲𝗱 𝘁𝗼 𝘄𝗶𝘁𝗵𝗵𝗼𝗹𝗱 𝘁𝗵𝗲𝗶𝗿 𝗻𝗮𝗺𝗲𝘀 𝗳𝗿𝗼𝗺 𝘁𝗵𝗲 𝗯𝗿𝗶𝗲𝗳 𝘁𝗼 𝘁𝗿𝘆 𝘁𝗼 𝗳𝗼𝗿𝗲𝘀𝘁𝗮𝗹𝗹 𝘁𝗵𝗶𝘀. (excerpt from Peter Irons, 𝘑𝘶𝘴𝘵𝘪𝘤𝘦 𝘢𝘵 𝘞𝘢𝘳.)

As a member of a Reform congregation, I find the URJ statement disappointing. How hard would the following have been? "Throughout history we have been uprooted and forced from place to place. We condemn this when it is proposed for any people. It is against our Jewish values."

How, after all we've seen, can some still wonder whether Trump will defy a court order? He's been fantasizing his whole adult life about being able to defy court orders. SMH #lawsky #academicsky

Fixed.

I'd be honored to give the talk on lawyers in Nazi Germany to other US Attorney's Offices, in person or by zoom. If in person, all I'd ask for is travel costs. (BTW I'm an AUSA alum, DNJ.) If you're in a position to make that happen, or know someone who is, please be in touch! #lawsky #academicsky

I gave my US Attorney's Office talk about Nazi lawyers today. I got a really warm reception and an interested, sizeable crowd. (And I grabbed a photo of this while I still could.)

Trump's throwin' it ALL the way back to the Articles of Confederation! "Article XI. Canada acceding to this confederation, and joining in the measures of the united states, shall be admitted into, and entitled to all the advantages of this union." #lawsky #skystorians #history #Canada

Check out our new book from Arcadia Publishing's Images of America series featuring photographs of the Japanese American community that was incarcerated at Heart Mountain before, during and after World War II. It's on sale now! shopheartmountain.org/collections/...

I posted the other day abt the phenomenon of "working toward the Führer"--trying to anticipate what Hitler would want & doing it w/o being ordered. Can't imagine a better illustration of it than this: The National Cryptologic Museum covered up posters abt "trailblazers"--women & ppl of color.

Kicking around L.A. w/nothing to do at 6:30 on Tuesday? I'll be giving this talk at Southwestern abt the lawyers who helped run the camps that imprisoned 120,000 people of Japanese ancestry in WWII. Free & open to the public. Registration here: docs.google.com/forms/d/e/1F... #LawSky #skystorians

There's no way that Trump & Musk are ordering each & every one of the actions agencies are taking. Lower-level officials are trying to imagine specific things they think Trump & Musk would like & putting them into effect. In Germany, it was called "working toward the Führer." tinyurl.com/mtwe94st
