Many good reasons not to criminalize failures to act (absent specific duty), incl’g: 1, it tends to be much harder to prove causation, where putative cause is an omission. 2, judging an omission is almost inevitably more subjective than judging an affirmative act, as number of omissions is infinite.

If a legal argument would not satisfy Rule 11(b), neither the argument nor its proponent should be entitled to retain a presumption of good faith.
I don’t think holding law professors to that standard runs much of a risk to free academic inquiry.
