A firing can be illegal, without therefore being a nullity. Being unlawful boils down to having consequences, such as owing remedies to the fired workers (after years of litigation). Takes that the firings are somehow a nullity are just childish and wrong. The murder analogy is apt.

The facts matter. Has anyone fired these people? Who? We don’t know yet. And yes, obviously a RIF can’t be done willy-nilly, but an employee fired in one won’t get far claiming they still have a job. It’s just childish to claim otherwise.

We need more facts. I don’t know who, if anyone, has said “you’re fired.” If/when USAID says it, these people are unemployed (even if DOGE pressed USAID to do that). I think DOGE’s remit to say it directly to employees is questionable. I’m not assuming DOGE did/will say it, which others are doing.

I thought I was clear that if DOGE tells these people that they’re fired, then they could dispute that. If, however, USAID tells them they’re fired, then they are indeed fired… and they should start looking for work; the litigation will take years to resolve. (2 of 2)

I’m not screaming about HR, I want people to stop giving bad advice online. It’s wrong to say that if a firing was unlawful, then it’s a nullity. People could get into trouble using employer property, for example. My post accounted for uncertainty about who (if anyone) said “you’re fired.” (1 of 2)

I’m literally saying if it was DOGE telling people they’re fired, then it’s not clear that it IS allowed. It would NOT be like a mass RIF implemented by the agency, which people are rushing to say is illegal (and therefore thinking it would be a nullity). But we don’t have all the facts yet.

Like… imagine an upright bureaucrat fires a MAGA employee. MAGA employee claims the firing was unlawful. Do you like the idea of the latter continuing to act in an official capacity, using government resources, until years of litigation finally resolve the issue? Get real! 3/3

You don’t keep acting as if you’re the government, when you’re not part of it anymore! That too would be unlawful! There are ways to remedy the situation, if indeed the firings were unlawful, but it’s aggravating to see takes that themselves promote lawlessness. 2/3🧵
