The medieval ordeal at least purportedly discerned
Abrego Garcia passed any possible test by ordeal
The signs are clear he’s innocent

iow the ordeal at least purportedly discerned
can’t justify this at all

It’s good reporting
I wish that it wasn’t called a crackdown
Because crackdown carries some positive meaning
Severe imposition of penalties for wrongdoing
This looks like arbitrary rule
Trial by ordeal, derogatory
Trump is pro-trial by ordeal
This can’t even be justified as a needed ordeal

Trump is pro-ordeal and hostile to due process as such
I don’t know if he will make a show of (blasphemous) regal/divine benevolence, I think it’s likely but that’s the best case
Even by standards of the medieval ordeal Abrego Garcia should be released, signs are clear he was taken in error

Trump should be asked, who’s really the barbarian?
Trump is against due process as such
And pro-trial-by-ordeal
But Abrego Garcia has been proven innocent
Whether you believe in due process going back to Magna Carta, or in trial by ordeal, the signs are clear he is innocent
Who is barbaric?

trump’s reaction (or lack thereof) to the attempt on the lives of gov. shapiro and his family ON PASSOVER is why it’s journalism malpractice to credulously report ANYTHING he does as being in service of fighting antisemitism.
jews are pawns in his nazi game and don’t ever get it twisted.

One likely scenario is that Trump makes a show of regal benevolence tomorrow
Trump is pro-trial-by-ordeal and anti-due-process
He's not just fighting against the US Constitution he's against Magna Carta and the Assize of Clarendon and the 1315 prohibition of liturgical blessings for the ordeal

I would kinda like to see Trump subjected to the "trilemma" of the ex officio oath
But it would lead nowhere good

a likely scenario is that Trump makes a show of regal benevolence tomorrow (or Tuesday) and does facilitate the release of Abrego Garcia
in a way that reinforces his brand
as the sole royal/divine dispenser of accusations and consolations
a blasphemous corrupt assertion of pro-trial-by-ordeal rule

In short, today's two filings are a defiant "screw you" to Judge Xinis and to Mr. Abrego. They say they can't "facilitate" anything because he's in Bukele's custody, they threaten to appeal any order she makes requiring them to take further steps, and they refuse to tell her anything.

The govt mischaracterizes the Supreme Court's order, as one to "facilitate the return" of AG. What the Court *actually* ordered was "to 'facilitate' AG's release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador."

Trump has a personal brand
Performing majesty while refusing responsibility
He has no feel for our freedoms and could not care less if we live or die

If I were betting I would say trump is likely to facilitate release
In a way that reinforces his disrespect for the courts and for due process as such and with a pro-trial-by-ordeal spin
That’s a best case

3. Just to be absolutely clear.
Those passages are from the Supreme Court's 9-0 opinion. Justice Sotomayor's statement begins below the highlighted passages.

2. DOJ's refusal to provide updates on efforts to get Abrego Garcia released from custody is also an affront to what the unanimous Supreme Court ordered.⬇️
I am sure Judge Xinis will take action, now with the backing of both the Fourth Circuit and the Supreme Court.

Results?
The WH released numbers
Were they actual lab results?
I am skeptical
LDL maybe
Triglycerides unlikely
PSA of 0.10? At age 78?
C’mon

The question is only whether the courts say "yes, my liege, you are the rightful King of all you survey, may you live forever" or "buddy, that's not how this is gonna play out"

At this point I think reporting on the Trump administration position should adopt a presumption of non-authority
Even if it's not exactly habeas, this is pertinent>>>

NEW: The Trump administration says it has no legal obligation to help Kilmar Abrego Garcia get to the United States. And the details of its arrangement with El Salvador to house U.S. deportees are classified, they say.

was the purported membership ever adjudicated? Did a judge find that to be a fact?

Probably not
But makes as much sense as some law firms apparently believing Trump is a satiable stationary bandit

Finally, and in one of the most obnoxious things I've seen in some time: DOJ — in addressing whether it should be ordered to show cause why it should not be held in contempt for failure to comply with Xinis's orders — does not address Xinis's orders at all, simply referencing the SCOTUS order.

BREAKING: In DOJ's response to the additional relief requested by Abrego Garcia's lawyers, lawyers make a number of significant assertions — including an exceptionally narrow view of "facilitate," which could mean Abrego Garcia would have no way to get back to the U.S. even if released.

That is also two days in a row in which the declaration provided by the government arguably was not "a declaration made by an individual with personal knowledge" of the information sought by Judge Xinis in Friday's order: www.lawdork.com/p/trump-admi...

And DOJ now advancing a variety of arguments for not disclosing these various instruments in the Abrego Garcia litigation—notwithstanding the reporting requirements of the amended Case Zablocki Act.

Trump is anti-due-process
And pro-trial-by-ordeal
Subjecting anyone to the trilemma of the ex officio oath testimony would be contrary to due process
But by Trump's logic (he's said innocent people don't need the 5th) he should have no problem with any "cruel trilemma"

THERE'S MORE: In a separate filing, the govenrment says its arrangement with El Salvador to house deportees in the notorious CECOT prison is classified. storage.courtlistener.com/recap/gov.us...
