BREAKING: D.C. Circuit panel allows Judge McFadden's injunction in the Associated Press access case to go into effect. McFadden's stay of his order ended at midnight, and the D.C. Circuit panel only scheduled arguments (for 4/17) on DOJ's requests for an admin stay and a stay pending appeal.

This Supreme Court gets graded on a curve. They delay and obstruct on behalf of an openly fascist administration, and then meekly ask it to “facilitate” (heaven forbid you “effectuate”) the return of an illegally deported man, but you must show “deference” to the executive branch’s foreign policy.

This ICE declarant “understands” nothing. There is no such thing as post-hoc invalidation of a lawful grant of withholding due to a future act which makes a person ineligible. If they want to get rid of it, they have to go through a process. They didn’t.

Yesterday they refused to answer two of the three questions ordered. Today's refuses to address, in any way, all three. None of this has anything to do with the order. This is open defiance of a district court backed by a unanimous three-judge circuit ruling and a unanimous 9-0 Supreme Court ruling.

Also if these detentions are part of an “alliance,” the people imprisoned in El Salvador are not in the “sole custody” of a “foreign sovereign.”

NEW: DOJ doubles down on refusing to follow Judge Xinis's orders. Today's status report contains nothing new. It again fails to provide information about steps they're taking to bring Mr. Abrego back), and arguably violates her command that a declaration be made by someone with personal knowledge.

NEW: A second filing today from the DOJ tells Judge Xinis that in their view, since Mr. Abrego is in Bukele's custody, she can't order them to do anything further to bring him back since that's not what "facilitate" means. They also say the deal with Bukele is classified and/or a state secret.

Serious point: This might be the most interventionist American government in my lifetime. The price of just about every good reflects the good thinking of the Commissars in Washington DC implementing their 5-year plan for National Greatness, rather than market forces.
