As the union representing the NLRB’s field staff, we only come to the public with critical issues affecting our members. We are sounding the alarm now. The NLRB is understaffed, underfunded, and now does not even have an operating board. Federal labor law is in full crisis. 🚨

It should also be mentioned that the specific person chosen for this illegal firing was the first and only black woman to ever hold a seat on the NLRB, just days before the beginning of Black History Month. The only Board Members remaining are white men.

More broadly, this is an attack on all independent agencies. The NLRB’s Members were provided for-cause protections and terms which carried over through presidential terms for a reason. The NLRA was designed to be administered by experts who answered first to the facts of a case.

Private-sector workers will be the ones who suffer most from this move. Any victim of an unfair labor practice will be unable to obtain a remedy for that violation so long as the perpetrator refuses to settle the case. Their livelihood will become just another file in the stack.

The immediate impact of this firing is that the NLRB now has just two Board Members, which deprives the agency of a quorum. Without a quorum, the Board cannot issue decisions on unfair labor practices. Federal labor law will not be enforced in a wide variety of circumstances.

First and foremost, this firing obviously violates Section 3(a) of the National Labor Relations Act, which grants for-cause removal protections to Board Members (unlike the General Counsel, who has no such protections).
It also violates long-standing Supreme Court precedent.

-Publicly endorsed a neo-Nazi party
-Routinely amplifies ideas and talking points from Nazis
-Publicly demonized Jewish organizations that have criticized the above
