If the United States wanted him out of that prison, he would already be home, with or without El Salvadorian assistance.

“He is detained pursuant to the sovereign, domestic authority of El Salvador.” Thoughts on this formulation having helped draft a number of declarations for State officials: 1) Unusual and may not have originated at State. 2) Emphasis on “sovereign” authority may presage further USG slow rolling.

There’s a special place in HELL for anyone who stands before the Supreme Court and argues that a man they wrongfully sent to an El Salvadorian death camp should stay there.

A president who has the power to send an innocent human being to a foreign concentration camp, but claims he lacks the power to bring them back, is committing the crime of false imprisonment.

It is very good question and one I’ve been asking for months. If there is an international agreement with El Salvador for these renditions, the Trump administration is legally required under the Case-Zablocki Act to share it with Congress. To my knowledge, they have not done so.

This is a concession by the U.S. government that its “arrangement” with El Salvador is irrevocable. To me this has to be grounds to argue that the arrangement itself is unconstitutional under the Fifth and Eighth Amendments
