Same, I got so confused, because on my end that line was just absent, but then I noticed that there are two versions, one per region groups.
I guess this is Musk's way to comply with EU's user protections while leeching off of everyone else.

Ah, I see the issue now. There are two versions of the TOS, one for the EU and one for outside the EU and within the US .
The "However..." line is only present in the version "if you live in the EU, EFTA states or UK"
So, for everywhere else that "backtracking" doesn't apply.
