This is right. But also, a key conceit of deportation allowing govt to skip normal criminal law process rules is that deportation is “non-punitive”. If you’re being sent to a foreign gulag to be held forever, that’s absolutely a criminal penalty and it should trigger full due process protections.

Is it the policy now for an ICE detention site not to provide a list of detainees to attorneys upon request? We got a weekly list at the detention center where I practiced but I’m curious if that’s stopped now (IIRC access was threatened under Trump 1) or if this is specific to Guantanamo?
