This is a concession by the U.S. government that its “arrangement” with El Salvador is irrevocable. To me this has to be grounds to argue that the arrangement itself is unconstitutional under the Fifth and Eighth Amendments

Not one reporter asked about the Executive Orders targeting Chris Krebs & Miles Taylor during today’s Cabinet press conference. Not one. A president using DOJ to punish those who spoke out? That’s banana republic territory. I waited. The question never came. Why? Has the fear already taken hold?

Absolutely this. Trump's DOJ will not act in good faith or with any sense of alacrity, or anything else approaching an effort to bring Abrego Garcia back for due process in a timely fashion. The longer he's in CECOT, the greater the chances are he becomes a "non-problem" for the Trump.
