If you are asked to leave you have to do so. But the act of banning you may often be winning the battle but losing the ear when it gets to court. If a premises owner can ask a trans person to leave and the GC activists say thats fine, then the premise has been set to demand they leave. Quid pro quo

Licensed premises laws relate to drunkenness and being drunk on licensed premises they are licensing matters. Not policing the toilets. If such was the case women would be thrown out for using the mens.
Common law use of force is to prevent assault. The 1967 act is about arresting for offences.

A breach of the peace is an act done or threatened, which puts someone in fear of assault, affray, riot or serious disturbance. Case law has firmed the point that it is the person causing this fear not someone just popping for a wee. It does not fit.
