Theres a great diagram showing the left/right split and whether its news or opinion/entertainment. As long as you stay news and stay centrist you're better informed than your peers. Unfortunately, the genie is out so we have to make do with what we have. A new media will suffer the same fate....

When news became profitable in the 1970s that spelled the end. Look at national discourse since. So yes, we should hold them to the same standard and they used to be. But I think it's basically impossible now without a 1A rewrite outlawing the demonstrable lies that for-profit news propagates.

And because you were so hasty weeks ago, Drew Ensign, et al, would have successfully appealed. That's the difference between you and a real judge. A real judge goes through the process building an airtight case so that their judgement can't be called into question by peers above them. That's law.

It doesn't matter who the person is. All that matters is the first person to clearly doesn't belong there comes before US Courts in some way to seek relief. In this case it happens to be him. No matter who it is, they can't be allowed to return to speak of what they've seen.

They are deliberately word-smithing their rulings to create that wiggle room. A direct order from SCOTUS, when ignored, will rob all remaining legitimacy from the Court. They know they're at the precipice and they're trying to avoid blowing past it. Unfortunately, it's inevitable.
