Judge needs to bring in Noem to answer questions. Immediately remand her and gov't lawyers assigned to case to custody until such time as Abrego-Garcia is returned.
Without a doubt. He may have immunity, they don’t. The arrest would be a mess as this DOJ won’t prosecute. Then, the whole charges by a special counsel ( I think I’m right here 🤷🏻♀️ Time to set new precedent.
This shouldn't even BE a hearing. He was kidnapped, trafficked and should be brought back. Period. STUPID using him for his hate poster child is cruel!
I’m not persuaded that anything will happen, to bring fairness to this process. Garcia is committed to a life sentence without the possibility of a fair hearing. So far, Judge Xinis has been played by Trump.
Sometimes when I’m outside, and I put my hands up to the universe, I can feel the energy come through my fingers. That’s when I know that somebody else is doing the same. It’s a great old video done by Jim Carrie on YouTube . Have you seen it? If not, I’ll find it for you.
XINIS says she intends to do as much of this in open court as possible, despite discussion of privileged materials. they can use the husher/phones if they need to reference confidential info, she notes.
XINIS signals frustration with the Justice Department for not making available officials with firsthand knowledge of Abrego Garcia's status and efforts to facilitate his return, despite her order. She notes the depositions were crammed with "I don't knows" from the witnesses.
NOTABLE: The Trump administration has labeled 1,140 documents related to Kilmar Abrego Garcia privileged and declined to produce them Abrego Garcia's lawyers. Discussion now is how to handle that large set of documents.
In this case, I imagine they're looking pretty deeply into the docs so that would be make it much more onerous.
Also 1140 only applies to the document itself as a whole. A document can have any number of pages in it that would have to be reviewed individually. Thats where the issue is.
The MAGA regime thinks our whole country is their privilege. Hello, it’s “We the People.” They work for us, those are our documents, and we want every single last MAGA out of the government NOW since FOTUS and the MAGA are anti-Democratic, anti-American, anti-Constitutional traitors.
That smells like their entire MS-13 file, just dumped into the case as a 'drown em in paperwork' attack, to see if they can get away with it.
More bad faith bs from DoJ.
UPDATE: DOJ attorney Jonathan Guynn reaffirms that Abrego Garcia was deported to El Salvador "in error" but says it was not "misconduct." Judge Xinis rejects that premise, notes Abrego Garcia was seized without a warrant or lawful authority. Guynn says that's not misconduct.
Might I suggest pulling in a bunch of the DOJ folks and hold them in contempt? This will go on and on until there is sufficient push back to stop this once and for all.If Guynn thinks that's not misconduct keep him in custody and set a court date for a month hence so he can ruminate and do research.
In fairness to this Trump DOJ attorney, it has long been US gov’t doctrine that officers and federal agents harassing, abusing, arresting or detaining people without cause or authorization is “not misconduct”
MORE: DOJ says there's been an update on Abrego Garcia from the Salvadoran government. According to El Salvador, he's being held in a penitentiary in Santa Ana and is in "good health." He has "gained weight."
Not that Xinis could compel the answer from ES but did she happen to ask WHY he's even being held? If it's not at our behest then what's the basis for him being in prison at all in his home country?
If all of us didn't know and say his name regularly, he wouldn't be doing well at all and they know that shit and still choose to argue for barbarity and treason instead.
Is Weight gain supposed to be good thing? Is it because he’s being keep in an area with zero activity? Poor quality starchy foods? If it was an error, it time he was bought back and compensated for the error.
IF seizing people off the street and sending them to death camps is not misconduct, then every member of this administration needs to grow eyes in the backs of their heads.
I thought I was good at manipulating the language but Guynn is working it so much harder than I'd ever manage. Kudos to him...in whstever lock up the judge sends him to...
(1/3) The bottom line is there are courts unfamiliar with this level of depravity and they clearly were NOT paying attention to "his" m.o.! They are not prepared and there are INNOCENT men, women, & children suffering the consequences of their ineptness to meet this moment head on! 👇🏾
(2/3) The court has the ability to arrest those unwilling to comply. Why aren't they? Why aren't they holding them in contempt? Even if it's for 3 days. I would personally stick them in cells next to, or in with, the worst offenders so they don't get a moment of sleep or peace. People are being 👇🏾
(3/3) harmed while they drag this out! These judges need to share tactics and use their legal war chest. All this polite back/forth isn't bringing him back or the others who were sent to this concentration camp! I guarantee if it were a white family member of the regime, this would not be happening!
She's building the record. She wants it to be solid, and she's being deliberate. An intricate dance. Also, there may be issues with ABA membership and law licenses as the thing unfolds.
According to @muellershewrote.com this hearing is about privileges and has to be held prior to holding anyone in contempt. Boo to that but they have to follow process. Horrific for Garcia.
Yes - the line is always that judges do this so it’s ’watertight’ but it always seems to give Trump and his goons time to delay and escape any justice.
How many hearings did these two Americans get? Never mind, they weren't deported, they were just jailed for three years without ever being convicted. One, because he was suspected of stealing a backpack.
Misdemeanor crime punishable by 365 days or less, theft of a back pack? These people were charged and locked for three years, two years longer than allowed…. There needs to be a national commission to study these acts: A. Fix broken systems operating on racism B. Accountability for violators
Look I was born in the south and raised in the south, the horror stories from these rural areas, need to stop!!!! All cops need to be licensed via the DOJ as such with a code of ethics…… same with judges and attorneys
Unfortunately, the legal system has proven itself useless against Trump. No one is willing to throw his ass in jail. Even after he has been found guilty, no judge will pass sentence and put on the cuffs.
So far, yes. But there is a limit to patience even among those who recognize that savvy. Laws have been broken, the Constitution ridiculed, and yet justice is still in limbo and perpetrators walk free to plan more skullduggery. It has to begin to end somewhere soon.
Comments
But the current Bondi DoJ has proven it is hearing impaired.
Without Due Process and Habeas Corpus, we cede being a nation of law.
So, send someone to jail.
Make it real, dammit
When is enough enough??
If Mr. Garcia was a man of means this wouldn't be happening!
If he were a white Afrikaner he would be invited to the US and granted refugee status!
If he ran a damned drug cartel, he would be granted asylum.
1140 depending on what you're looking for is not a sizable amount.
1/2
In this case, I imagine they're looking pretty deeply into the docs so that would be make it much more onerous.

It's a bunch of stall tactics.
This judge and ALL judges MUST call bullshit and ORDER ALL documents to be given to the judge and defense.
Hold them in contempt and PUT THEM IN A JAIL CELL!
More bad faith bs from DoJ.
Then ask him again.
(Yes, I’m yelling!)
(see: the entire concept of qualified immunity)
These assholes 😒
Directly violating the fucking Constitution is "not misconduct"????
Contempt. Contempt for them all.
"Because of the manacles?"
"Er..." (smokebomb)
That’s what happens when you are only allowed to eat low quality processed foods
These DOJ attorneys keep showing how uninformed they are every single day
Acting without lawful authority isn't misconduct?
Guess I'll go arrest and imprison Donald Trump, then.
I guess I missed it....?
Enough is enough already!

Who is going to El Salvador to see him?
Is he still in the CECOT concentration camp?
🚬😎
Nobody wants to be the judge that gives the order that becomes the official end of the rule of law in the United States when the order is refused.
