In the cases I’ve dealt with where one party refused the divorce, the couples ALL got divorced ultimately. So, given that, and given the “opt in” aspect of the law, I’m not sure that anything would practically change. Maybe some of you have experiences with divorce in the

In 28 years I’ve only dealt with three cases where a party refused to agree to a divorce and the other didn’t have grounds. In my experience, even someone who doesn’t want a divorce will agree to be divorced when push comes to shove. You can’t make someone love you, or even be decent.

I practice law in Mississippi. We have irreconcilable differences divorce, where couples can divorce if both agree to get the divorce, and obviously we have fault based divorce. We don’t have “no fault” divorce where one party can obtain a divorce without proving grounds.
