The EHRC has overreached in Falkner’s haste. If they go ahead with these proposals the article 8 challenges will come thick and fast - and not just from trans people, but gender non-conforming cis women who will also inevitably be affected.

This is absolutely the correct approach and would give us *actual* clarity. (As well as reinforcing parliamentary sovereignty which of course we all love.)

My instinct is that those would need to be separate programmes of positive action, but yes, positive action to benefit trans people, who are undoubtedly underrepresented in parliaments(s), could/should indeed be a thing.

It sucks, it’s perverse, it’s a total distortion of what parliament intended, but right now it’s the legal reality we find ourselves in and any entity seeking to include trans women in positive action to benefit women puts itself at risk of legal challenge.

The main difference for me between going circa 2006 and then again a couple of years ago was that in 2006 when I tried to speak basic but not entirely awful French the waiters responded in English disdainfully but in 2023 they did it sympathetically.

Indeed, although I think it is very telling that every interview with Baroness Falkner includes her saying both that the law is now clear and that service providers and lawyers should get their own legal advice.
