They had reasonable suspicion to detain him, then gained probable cause to arrest him from…all the illegal stuff he had on him.
There’s also a misconception that he had to have rights read before arrest.
For a clean sample you want a cotton swab from a cheek.
Off food your most likely only have a partial sample that could match thousands of people in the area.
But the CSI affect mean juries assume it's always extremely accurate & only shows one person.

Placing objects and food to get fingerprints and dna is super common and legally protected, unfortunately.
