Its available. Traditionally, you petition and a judge issues a writ for you to appear to determine if the detention is lawful. You can ask for injunctive relief to prevent your right to due process from being violated.

Ruling was over jurisdiction. They said previous judge was in the wrong state and used the wrong law. ACLU refiled in the right state under the proper law.

I don't think so. Law of the case runs with "the case" and this is a new case, even though it is very similar to the other one. Coordinate courts aren't bound except by preclusion, but nothing was decided on the merits in DC so no preclusion. Rulings of the Supreme Court remain binding, obviously.
