less the rule of law is gonna be followed, more that it's way harder to deport the amount of people trump has wanted for a while like 15-30 million. they're definitely gonna try unfortunately
II think it's likely the same apparatus. If the whole position is, once they're gone, they're gone, then the only time you have standing to sue is once you've been disappeared. A legit SCOTUS would refrain from mealy-mouthed opinions and force the conflict. Make it a political issue.
in what way will that apparatus be different from the apparatus that was used against abrego garcia? given that there was no due process and there was 1. a court order explicitly forbidding him from being sent to el salvador 2. a supreme court ruling ordering him to be returned.
in other words, ICE could just "accidentally" send an american citizen to a foreign gulag and then after the fact recognize their mistake but say "whoops there's nothing we can do about it now." what protection do citizens have that a legal resident doesn't? the same constitution applies to us all.
Fascists act first and deal with consequences (if there even are any) later. They will do exactly what they want to do unless there is significant political or populist opposition, and even then they will do whatever they can get away with.
What legal apparatus do they need beyond their current strategy of "sorry, plane left, our hands are tied?" If you are ignoring court orders on a pretense, why change the pretense?
