Problem is with chapter 1, which contradicts chapter two and the reference to XX and XY Chromosomes. Because People with XY Chromosomes and Vagina produce the big reproductive cell and can have children, if the combination of XY and XY results in XX or XY and not YY.

It's not really accurate, though. We all start out *undifferentiated*, not "female".

Around week 7, "normally" the virilization cascade is triggered by SRY in those with a Y chromosome, and "normally" each of its steps proceeds as planned.

But everything doesn't always go normally. It's brittle.

Courts generally try to interpret things by "legislative intent" - the "intent" being "the gametes that they would eventually produce". But they're going to have a lot of trouble doing that in this case...

It was in "The Selfish Gene" back in 1976. It distinguishes sex across species, many of which don't have XY chromosomes. They may not determine sex by DNA at all, such as alligators incubating eggs at different temperatures.

They claim strategies for evolutionary success are different if there's more metabolic investment per gamete. But like, in humans, that's a tiny part of the difficulty of parenthood. There are also a lot of other ways to define biological sex in humans.
