🧵 There are a lot of misleading claims out there about the SAVE Act. Let me set the record straight: I voted for the SAVE Act for the simple reason that American elections are for Americans. Requiring proof of citizenship to register to vote is common sense.

The law clearly violates the constitutional provision which says House voter qualifications are the same as "for Electors of the most numerous Branch of the State Legislature". So states can let non-citizens vote. The Senate's similar but with "the most numerous branch of the State legislatures".

More of a theoretical point and hasn't been litigated because no state lets non-citizens vote for state legislature. A few localities allow it but that's restricted only to their local offices, not state level races. States could in theory but since they don't, no such person exists for standing.

I just meant narrowly on the point about the clause setting congressional voter qualifications to be the same as for state legislature. A state would first have to actually say non-citizens can vote for legislature to get the conflict with Congress trying to say that person can't vote for Congress.

In Minnesota, as in every state, you still have to swear you're a citizen under penalty if you do it falsely, and it's still a crime on top of that to cast a ballot as a non-citizen or if you're otherwise ineligible.

SAVE Act would make traditional voter registration drives impossible. That's the real goal of it. States can already do voter ID at the polls, many do. This requires 'proof' be presented by the voter directly to the registrar (e.g. county clerk). Which means orgs can't collect and turn in the forms.

It also undermines motor voter laws, since you now need to show ‘proof’ plus photo ID at time of voter registration, so unless you bring additional docs beyond what you would need for a Real ID when you apply for your drivers license, you need to wait for your license and then go back to register.

Last I checked, the list of documents in the SAVE act that are sufficient ‘proof’ of citizenship plus photo ID includes a Real ID, but does *not* include the documents that would be sufficient to get a Real ID. You need to apply for the Real ID first then wait until it arrives to register to vote.

Reviewed the latest draft of the SAVE act and this is still true. To register to vote alongside an application for a drivers license, you would now need to present “documentary proof of US citizenship” at the DMV, defined in the act to mean only 5 specific types of documents.

Notably, the acceptable documents in SAVE are beyond what you would need to apply for Real ID. In practice, unless you think to bring a passport with you to the DMV, you will need to wait until your license arrives, then go back in person to register to vote—defeating the purpose of motor voter.

This is making it so that registering to vote requires proof of citizenship. Unless you have a passport, your birth certificate is your proof of citizenship. Your married name is not on your birth certificate. So married women will have to bring a birth certificate, drivers license & marriage & 1/n

Elections offices will be open Monday-Friday during traditional business hours--so people will have to TAKE OFF WORK to register or update their registration!

Also: Elections offices are already understaffed and overwhelmed, esp when preparing for an election. This will overburden them.

In Indiana currently at the polls if the clerk has a voter with a changed name or address, they are told to send them to the inspectors to fill out a vr11 form. Which updates that info... And then the system lets them continue to voting. That would be a complete changed process

I’ve seen some reports mentioning this would ban voting by mail, or place severe restrictions on it—is that true? How would states that do all voting by mail (like Oregon where I live) be affected? We’ve been all vote by mail for over twenty years now & there’s zero desire to change that
