I still don’t see a good argument against charging him with bribery under NY state law.

Emil Bove has just made himself one of the worst villains in US federal legal history. He should never be forgiven for this.

No personal or professional redemption.

Disbar him ASAP and issue a restraining order to keep him at least 500 feet away from the law at all times for the rest of his life

I keep calling for Adams to be charged under state law. Everything sdny charged is also a violation of state law. The case is completely built.

I wasn't referencing Trump v US. My, very IANAL, understanding is that state criminal suits against federal officials acting under a broadly interpreted official duty will a) get removed to federal court b) have rather broad immunity against state prosecutions.

I think you're somewhat mistaken, there already was immunity against state criminal charges for a federal official acting in their official capacity.

The recent Supreme Court decision granted sweeping immunity to the president against federal charges. Different.

My mistake. I thought he was referring to Trump v. US. I guess the question re: Neagle is whether bribing a mayor by not prosecuting him for bribery in exchange for him ignoring state law qualifies as an official act. Under this court, it might!

Probably some McCulloch v. Maryland type of argument that the state of New York can't apply its bribery laws to the federal government. I don't really find the argument persuasive because the feds can apply its laws to state governments.

my rudimentary understanding is that even if federal-officer removal works in this case (as it should?), and he was ultimately convicted by a federal court on a state-law charge, that would still be beyond the pardon power

I'm not a NY lawyer but depending on evidence/testimony re: this nuclear footnote in Danielle Sassoon's letter, it does seem Bove could be up for 3rd degree bribery under NYPL 200 (and Adams arguably on 1st or 2nd if he authorized that offer)

There’s a world of difference between what you know and what you can prove beyond a reasonable doubt to a unanimous jury. News stories full of credible hearsay are wildly different than sworn statements from witnesses who you know will testify.
