It’s rightly recognized as ratified.There no deadline in the Constitution to pass an Amendment & an enacting clause (not Amendment) mentioning a deadline is invalid. It took 200 yrs to ratify the 27th, which was one of 12 Amends proposed by James Madison (only 10 passed & became the Bill of Rights)
Yay! The required number of states have ratified it and all Constitutional requirements met. The US Archivist has just refused to publish it, as the Constitution requires. President Biden publicly telling the archivist to do what law requires, this Amendment is 28th in all future publications.
The last thing Biden should do on his way out the door is sign an executive order to suspend executive orders for the next 4 years. Stop the felon 47 in his tracks and let it go to the courts to decide the real extent of the president’s power.
That is not how executive orders work. And even if Biden did do that, Trump would just reverse it with another executive order. That's the problem with them as a concept. They are always reversable by the next president that comes in.
Pointless. Doesn't mean anything and he waited far too long to call on the Archivist to publish. The archivist hasn't and said she won't. There is nothing legally to challenge.
they'll argue that previous amendments 18th, 22nd, contained deadlines, though I'd argue back that none of them needed deadlines. In the last few, like the 26th and the 25th, the deadline does not appear in the Constitution, suggesting it was not wholly part of the amendment.
its more about political posturing than it is about policy. most of our real effectual laws get passed in lame duck sessions and the end of term out the door stuff. i think partly because they didn't have the political currency to get it passed while they were in office.
The amendment would need to be formally published or certified to come into effect by the National Archivist — and when or if that will happen is unclear.
The only amendment in our history to be ratified and then undone is the prohibition of alcohol. That took over a decade to do. Doesn't matter how many lawyers who hate gender equality will fight against this, it's not gonna be easy. And that's a good thing.

Unfortunately in this case, Good intentions tweeted or put out in press release does not make it law. Pres Biden did not & will not order the archivist to publish it. He doesn’t want to violate separation of powers. In this case, I wish.
True! Biden has a 1USC106(b) duty to order the Archivist to publish the 28th Amendment the ERA! Email her at [email protected] and tell her to stop interfering with our Constitutional process!
This is a significant step forward for gender equality! However, the legal battles ahead will be just as important as the ratification itself. It'll be interesting to see how this unfolds and what it truly means for rights moving forward.
Regardless of what happens, this is brilliant politicking. In all likelihood it gets struck down on a challenge from the Trump administration, putting it back on center stage that he is blocking reproductive rights in time for midterms. Game appreciates game.
Then Trump would have had time to craft a message about it. This way, to the average person that the last 4 years have definitively proven just goes by the correlation of whose in office when they notice something, he appears to own it.

Has Biden ordered it published? Just saying he believes it meets requirements is lame. Once he orders, does the Archivist have a legal say? It will definitely be challenged. Let the MAGAs tell women they don't deserve equality under the law and want to reverse it.
How evil would you be to challenge this?, even if you actually had a case, which they don’t: “Amendment to the Constitution requires ¾ of states, or 38, to ratify it. Virginia was the 38th”. An no, ratification does not accept take-backs. It is a one-way process.

I was damaging my brain this morning with AM radio and they were going on complaining that it was illegal for Biden to pass ERA and I was trying to understand what their angle was, but they straight up just said women shouldn't have equal rights bc it wouldn't affect gender roles. So wild.

Virginia passed their ratification in January of 2020. Biden had the duration of his entire administration to make this move. One has to wonder how important it actually was to him.
If he did it years ago, it would have had a chance to be tossed quickly. At keast by doing it now, this could gum up the courts for even just a day, before they line up all the ills they have ready.

The text of the Equal Rights Amendment contained a ratification deadline. The amendment was not ratified by the requisite number of states prior that deadline.
Biden gave his opinion on the way out the door, he didn’t take exec action. He had 4 years to do so. Nat’l Achivist has already stated they won’t publish the ERA.

I have observed a reason beyond "equality" for Fathers not being allowed to have their kids in their lives: The child's safety.
Which is usually the real reason behind the courts decision.
