You can't bring a lawsuit for "on behalf of the entire pissed-off half of the country." You need to allege specific injury, and can only pull in "all others similarly situated," which isn't that many. This is how the orders get challenged in court, one at a time.

not a lawyer - but the Constitution states, "whose Appointments are not herein otherwise provided for, and which shall be established by Law", which would mean that the President cannot simply make up an office - Congress has to. So first Congress would have to pass a bill creating DOGE.

Whether or not you draw a paycheck probably isn't the line. Kushner was unpaid, I believe, but had a title, a desk, security clearance, and full authority to do a huge amount on behalf of the President.
