It’ll be interesting to see if DOJ will be in as much of a hurry to take *this* case up to #SCOTUS as it was the Dellinger case.
My own bet is “probably not,” especially given the loss here was before a pretty friendly panel—and Judge Forrest’s (IMHO, unanswerable) points about “irreparable” harm.
