IANAL but that criminalizes “any threat to take the life of, to kidnap, or to inflict bodily harm upon the President of the United States”. It does not criminalize musing about same, in the abstract, absent a concrete threat. Is there some case law to the contrary, that overrides the 1A?
I didn’t say he committed a crime, I just don’t think it’s obvious that law enforcement wouldn’t want to speak with him. Nor do I think it’s a huge injustice that they would do so.
I cannot even fathom the degree of ego required for an economics professor in a foreign country to argue with a U.S. constitutional law professor and lawyer about First Amendment in the U.S.
It's the same degree that allows one to not even read that article on which they opine, because if they did they'd see the article actually clearly states the legal framework and explicitly states that no law has been violated.
I promise you this article does not come within a country mile of this statute as construed constitutionally. They can knock and talk any time they want over any old thing. They could not get even get probable cause on this though.
